(NYT54) WASHINGTON -- Jan. 23, 2003 -- SCOTUS-DRUG-PRICES -- The Supreme Court appeared on Wednesday, Jan. 22, 2003, to be searching for some way to avoid a definitive ruling on the legality of a program in Maine to lower prescription drug prices. Several justices suggested that they might send the case back to a federal district judge in Maine. That judge could examine the program more closely and solicit the views of the secretary of health and human services. Some judges urged a review by Secretary of Health and Human Services Tommy Thompson. Thompson, center, with President Bush and the Commissioner of Food and Drug Administration Mark B. McClellan, left, in the Oval Office, Dec. 18, 2002. (Doug Mills/ The New York Times)
