Moses was convicted Sept. 15, 2005, of three felony counts of illegally discharging sediment and fill into the creek, which runs intermittently near a subdivision. Moses faces up to nine years in prison and $750,000 in fines in what federal officials say is the first criminal prosecution under theClean Water Act in Idaho.
