A quarter-century ago, the Puerto Rican Legal Defense and Education Fund sued New York City, charging that one of the city's promotion exams for police officers discriminated against minorities because it was culturally flawed. The exams, the group charged, were yielding unfair results: Too many whites were doing well, and too many Hispanics and African-Americans were not. The lawsuit also reflected the wishes of the defense fund's active board of directors, a group that included a young lawyer named Sonia Sotomayor. Two decades later, the young lawyer had become a federal appellate judge, and a volatile case had forced her to confront the issue of promotion tests and race again.
