(NYT53) PASCAGOULA, Miss. -- Oct. 4, 2005 -- KATRINA-INSURE -- Richard F. Scruggs in his hurricane-damaged house in Pascagoula, Miss., on Tuesday, Sept. 20, 2005. Scruggs has filed a lawsuit on behalf of a nearby resident seeking to force an insurer to pay for flood damage from surging water. Insurers say their policies specifically exclude coverage for any kind of flooding, and lawyers specializing in insurance say there has never been a successful legal challenge of their position.
